Eric Wahrburg

Eric Wahrburg is an associate in the New York office of Manning & Kass. Mr. Wahrburg joins the firm with more than 5 years of experience within the area of insurance defense, specializing in appellate practice, where he successfully argued several cases before the various appellate courts of the State of New York.

During law school, Mr. Wahrburg worked with the Office of the District Attorney of Suffolk County, where he assisted in the prosecution of large scale insurance fraud cases.

Successfully argued appeal before the New York Appellate Term, Second Department clarifying the burdens of proof at trial in a No-Fault action, Dayan v. Allstate Ins. Co., 49 Misc. 3d 151(A) (App. Term, 2d Dept., 2015), The Appellate Division, Second Department relating to the burden to vacate an arbitration award, Singh v. Allstate Ins. Co., 137 A.D.3d 1046 (App. Div., 2d Dept., 2016) and the Appellate Term, First Department holding that a defense of policy exhaustion is not precluded if not raised during an arbitration proceeding.
