Trusts and Estates

The Manning & Kass Trusts and Estates Team, led by Daniel B. Herbert, is a full service practice group, highly skilled in every aspect of trust and estate litigation, planning, and administration. Mr. Herbert is a member of the Los Angeles County Bar Association's Trust and Estate Section and Trust Litigation Subcommittee; California State Bar's Trust and Estates Section; Illinois State Bar Association's Section on Trusts and Estates; American Bar Association's Real Property, Probate and Trust Section; and the ABA Estate and Trust Litigation Committee.

Our Trusts and Estates Team handles:
    • conservatorship and guardianship litigation;
    • estate planning;
    • probate litigation;
    • professional liability (trustees and other fiduciaries);
    • tax issues, including estate, gift, capital gain, and property tax;
    • trust and estate litigation; and
    • trust and probate administration.

As effective and experienced litigators, we are happy to try your case when trial is necessary (after first exhausting settlement and other efforts). Our team has won numerous multimillion dollar cases. We enhance our expertise, moreover, by collaborating with the firm’s other teams. For example, our Strategy, Writs, and Appeals Team, with six certified appellate specialists, commonly supports our appeals, while our Professional Liability Team often joins us in defense of trust and estate attorneys and other professionals.

We administer many trusts and probate estates, from the very large to the not-so-large. We’ve recently administered trusts and estates holding dozens of commercial properties, hundreds of apartment units, music royalties, oil and mineral interests, famous paintings and other fine art, and yachts. We have also administered countless smaller estates, more likely to involve a home, retirement accounts and other investments, and family valuables.

Although we often plan very large, taxable  estates, we are also efficient with more basic planning. At either end of the spectrum, we are proud to provide quality service and a high-value product. In any plan, we help our clients provide for their families, plan for succession, preserve wealth, avoid probate, minimize or eliminate estate and other taxes, and leave specific instructions for health care and end of life decisions.
